Information regarding data protection
Welcome
Holcim values you as a customer or as anyone else interested in Holcim and our products, technologies, and services. During our relationship, we will collect and process some of your personal data. This Data Protection Notice explains how Holcim will use the personal data you provide and informs you about your rights and options in this regard. This Notice applies to the personal data you provide to Holcim and the data obtained from it. Usage information collected through cookies or other online tracking technologies is subject to our Cookie Policy, which can be found on the relevant Holcim website.
Who is responsible for your personal data?
Your personal data will be controlled by Holcim Polska S.A. with its registered office in Małogoszcz, ul. Warszawska 110, country: Poland, or by another entity associated with Holcim specified in the correspondence you will receive, which is the controller of personal data, or by a group of entities that are also joint controllers of data responsible for the security and integrity of your personal data. For what purposes do we use your personal data?
We will only process your personal data for the following purposes ("Permitted Purposes"):
- Planning, conducting, managing and administering your (or a third party with whom you are associated) contractual business relationship with the Holcim Group, e.g. by executing transactions and orders for products or services, processing payments, carrying out accounting, auditing, billing and collection activities, arranging shipments and deliveries, facilitating repairs and providing support services and providing other services or things that you may have requested from us;
- Maintaining the security and protection of our products, services and websites or other systems, preventing and detecting security threats, fraud and other criminal or malicious activities;
- To comply with legal compliance obligations, such as compliance checks or record-keeping obligations (e.g., under antitrust laws, export laws, trade sanctions and embargo laws, anti-bribery and corruption laws and internal regulations, or to prevent white collar crimes or money laundering), which may include automated checks of your contact and identification details against applicable sanctioned party lists and contacting you to confirm your identity in the event of a potential match, or recording your interactions with third parties, which may be relevant for competition protection purposes;
- Resolving disputes, enforcing the performance of our agreements and demonstrating the validity, filing or defending claims; or
- Ensuring compliance with legal requirements, such as maintaining sales records for tax purposes or sending notifications and other information as required by law.
We will not use your personal data to make any automated decisions about you or create profiles other than those described above.
The legal basis for processing your personal data is set out in Article 6 of the European Data Protection Regulation. Depending on the Permitted Purposes for which we use your personal data, the processing is not necessary for the performance of a contract or other business arrangement with Holcim, or necessary to comply with our legal obligations, or is necessary for the purposes of our legitimate interests, provided always that your interests or fundamental rights and freedoms do not override them. Furthermore, processing may be based on your consent if you have expressly granted us your consent.
What personal data do we collect?
In particular, we may collect and process the following categories of personal data:
- Contact information, such as your full name, work address, work telephone number, work mobile phone number, work fax number, and work email address;
- Payment data, such as data required for payment processing and fraud prevention, including credit and debit card numbers, security code numbers and other billing information;
- Further business-related information necessary for processing as part of a project or contractual relationship with Holcim or information voluntarily provided by you, such as orders placed, payments made, applications and projects;
- Information collected from publicly available sources, data integrity databases, and credit reporting agencies; and
- Where required for legal compliance purposes: information about relevant and important litigation or other legal proceedings against you or a third party related to you, and information about our relationship with you that may be relevant for competition protection purposes.
Special Categories of Personal Data. In connection with registering for or providing admission to an event or seminar, we may request information about your health to identify and address any disabilities or special dietary requirements you may have. Your consent is the basis for any use of such information. If you do not provide us with such information about your disabilities or special dietary requirements, we will not be able to take any appropriate precautions.
Other Personal Data: Occasionally, we may ask you to provide us with information about your date of birth, habits, or preferences in order to send you messages with greetings on important dates. Your consent is the basis for any use of such information.
How we collect personal data
We will primarily collect your personal data directly from you. We do not collect personal data from third parties, except as otherwise set out in this document (e.g., information from publicly available sources, data integrity databases, and credit reference agencies).
How do we protect your personal data?
We maintain physical, electronic, and procedural safeguards in accordance with state-of-the-art technical requirements and data protection laws to protect your personal data from unauthorized access or intrusion. These safeguards include implementing specific technologies and procedures designed to protect your privacy, such as secure servers, firewalls, and SSL encryption. We will always strictly comply with applicable laws and regulations regarding the confidentiality and security of personal data.
Who will we share your personal data with?
We may share your personal information:
- With our Holcim Group affiliates worldwide, where permitted by law and to the extent necessary to fulfill the Permitted Purposes. In such cases, these entities will then use your personal data for the same purposes and under the same conditions as those described in this Privacy Notice. - To service providers (so-called data processors) within or outside the Holcim Group, domestically or internationally, such as shared service centers, instructed by us to process personal data for the Permitted Purposes on our behalf and solely in accordance with our instructions. Holcim will retain control over and remain fully responsible for your personal data and will use appropriate safeguards required by applicable law to ensure the integrity and security of your personal data when we engage such service providers.
- Any court, law enforcement agency, regulatory body or legal professional where legally permitted and necessary to comply with a legal obligation or to establish, bring or defend legal claims.
In other cases, we will only disclose your personal data when you instruct us or consent to do so, when we are required to do so by applicable law or regulation, or when we receive an official or judicial request to do so, or when we suspect fraud or criminal activity.
Where do we process your personal data?
The Holcim Group is a globally operating company. In the course of our business activities, we may also transfer your personal data to recipients in countries outside the European Economic Area ("third countries") where applicable law does not provide the same level of protection as the law in your home country. When we do so, we will comply with applicable data protection requirements and implement appropriate safeguards to ensure the security and integrity of your personal data, in particular by entering into EU Standard Contractual Clauses, in accordance with the European Commission's guidelines set out in Commission Implementing Decision (EU) 2021/914 of 4 June 2021 on standard contractual clauses for the transfer of personal data to third countries under Regulation (EU) 2016/679 of the European Parliament and of the Council, the content of which can be found at the following link: https://eur-lex.europa.eu/legal-content/PL/TXT/?uri=CELEX%3A32021D0914. Your data protection rights
Subject to certain legal conditions, you have the right to request access to, rectification or erasure of your personal data, as well as the restriction of processing of your personal data. You also have the right to object to processing and to request data portability. In particular, you have the right to request a copy of the personal data we hold about you. If you exercise this option repeatedly, we may charge a fee for this. Please refer to Articles 15-22 of the EU General Data Protection Regulation (GDPR) for detailed information on your data protection rights.
For any of the above requests, please provide a description of the personal data at issue, your name, your customer number (or other Holcim identification number), and your contact information below. We may require additional proof of identity to protect your data from unauthorized access. We will carefully consider your request and may wish to discuss with you how best to fulfill your request.
If you have consented to the processing of your personal data, you may withdraw such consent at any time with future effect. This means that withdrawing consent does not affect the lawfulness of processing based on consent before its withdrawal. If you withdraw consent, we may continue to process your personal data where another legal basis exists for such processing.
If you have any concerns about how we are handling your personal data or would like to make a complaint, please contact us using the details provided below so we can investigate the matter. If you are not satisfied with our response or believe that we are processing your personal data unlawfully, you can lodge a complaint with the relevant data protection supervisory authority in your country.
What if I'm under 18?
Individuals under the age of 16 must obtain parental/guardian consent before providing us with their personal information. Individuals under the age of 16 are not permitted to provide us with their personal information without such consent.
Is it necessary to provide personal data?
As a general rule, you provide personal data completely voluntarily; in principle, refusing consent or disclosing personal data will not have any negative consequences for you. However, in certain circumstances, Holcim cannot take action without certain personal data because, for example, this personal data is required to conduct legally required compliance checks. In such cases, if you do not provide your personal data, we may not be able to provide you with the services you have requested.
The period of storage of your personal data
Your personal data will be deleted when we no longer have a legitimate need to retain it for the Permitted Purposes or you withdraw your consent (if applicable), and we are not legally obligated or otherwise permitted to retain such data. In particular, we will retain your personal data where necessary for Holcim to assert or defend a legal claim, until the end of the applicable retention period or until the relevant claim has been settled.
Updates to this data protection notice
This Privacy Notice was last updated in October 2024. We reserve the right to change or revise this Privacy Notice from time to time to reflect changes in the way we use your personal information or changes in legal requirements. If any such changes occur, we will post the revised Privacy Notice on our website or otherwise make it available to you.
